If you are responsible fo a non-domestic property then you are responsible for ensuring compliance with regulation 4 "The duty to manage asbestos" of the Control of Asbestos Regulations 2006. The regulation also applies to communal areas of residential properties.
This regulation came into force in November 2004, ARE YOU COMPLYING?
This regulation requires the duty holder to identify the presence of asbestos within the premises, record the location, assess the condition of the asbestos and asses the risk posed to employees. There must also be a written plan detailing how the asbestos containing materials will be managed and the risk minimised.
If the building does not contain any asbestos containing material there still must be a document detailing evidence of areas inspected and stating there is no asbestos present.
If there is not a written asbestos management plan then you are in breach of the regulations.
